This website, www.bottlersmarque.co.uk is operated by Bottler’s Marque Company Ltd, UK company number 14508967, with its registered office at 124 City Road, London EC1V 2NX, United Kingdom.
By placing an order via our website, you as a buyer agree that your interaction/s, purchase/s and transaction/s with us is/are governed by these Terms and Conditions of Sale.
- Definitions & Interpretation
1.1. In these Terms:
- “we”, “us”, “our” means Bottler’s Marque Company Ltd (the seller).
- “you”, “customer”, “consumer” means the person placing the order.
- “Goods” means the bottled spirits or related products sold via our site.
- “Order” means your order for Goods placed via our site, accepted by us.
- “Contract” means the sale contract between you and us.
- “Cooling-off Period” means the statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (as amended) or equivalent UK consumer law.
1.2. Headings are for convenience only and do not affect interpretation.
- Eligibility & Age Requirement
2.1. If you are a UK resident, you must be at least 18 years old to place an order (this must be your minimum legal age on the day and date that you place an order). If you are a resident of another nation, you must be of legal age to purchase and consumer alcohol in your country of residency. By placing an order you confirm that you are legally permitted to purchase alcoholic beverages in your country of residence.
2.2. We reserve the right to refuse or cancel any order if we have reason to believe you are underage or if the order would breach applicable laws regarding alcohol.
- Order Process & Acceptance
3.1. To place an Order, you must follow the checkout process on our website and provide all required information (delivery address, payment, etc.).
3.2. We may accept or decline your Order at our discretion (for reasons including stock availability, verification failure, or regulatory compliance).
3.3. You will receive an order confirmation email automatically upon placing an Order (this does not constitute acceptance). We will email a shipping/dispatch confirmation once we accept and dispatch your Order, at which point the Contract is formed.
3.4. If we cannot accept your Order, we will notify you and refund any payment made.
- Prices, Taxes & Payment
4.1. The price payable is that quoted on the website at the time you place the Order, subject to any applicable discounts or promotions.
4.2. All Prices include UK VAT, and for alcohol, prices also include UK alcohol excise, which is a mandatory tax levied on all alcohol sales in the UK. If you are outside the UK, additional import taxes, duties, or customs charges may apply, which your government of residence will usually require you to pay before you can receive your delivery.
4.3. We accept payments by debit and credit cards issued by Mastercard and Visa.
4.4. Payment is processed via secure third-party payment providers. We do not store full card details.
4.5. You must ensure that the payment method is in your name or that you are authorized to use it. We may perform identity verification or fraud checks before accepting orders.
- Delivery & Risk
5.1. We will deliver the Goods to the delivery address you specify. Until we update our terms, delivery is only to addresses in the mainland United Kingdom nations of England, Scotland and Wales (please see our Shipping, Delivery and Returns policy).
5.2. Delivery times are estimates and may vary (delays may occur due to stock, courier, weather, regulatory checks).
5.3. Risk of damage or loss passes to you when the Goods are delivered. Title (ownership) passes to you once we have received full payment.
5.4. You should inspect Goods on delivery and notify us promptly of any missing or damaged items.
- Cooling-off / Cancellation Rights (Unopened Goods)
6.1. If you are a consumer (i.e. not buying wholly or partly for business use), you have the right to cancel your Order within 14 calendar days (the “Cooling-off Period”) without giving a reason, subject to some limitations.
6.2. The 14-day period runs from the day after you (or a third party you nominate) receives the Goods.
6.3. To cancel, you must inform us in writing before the period expires, using the contact form or email address published on the Contact Us page of this website.
6.4. If you cancel and the Goods have been delivered, you must return them to us unopened, in the same condition, with original packaging, and within 14 days of cancellation notice. You bear the cost of returning the Goods unless the Goods were damaged or sent in error.
6.5. Upon valid cancellation, we will refund you the price paid (excluding delivery charges, unless the entire Order is cancelled) within 14 days of receiving the returned Goods (or evidence of return).
6.6. We may withhold refund until we have received the Goods or evidence of returning them.
6.7. If you use the right of cancellation, you are responsible for any diminished value of the Goods resulting from handling beyond what is necessary to ascertain its nature and quality.
- No Cooling-off / Returns for Opened or Perishable Goods & Exceptions
7.1. Alcoholic beverages are generally exempt from cancellation rights under UK consumer law once the seal is broken (i.e. once a bottle is opened or the tamper-proof seals are removed).
7.2. Therefore:
- If you have opened or used the Goods, unfortunately you do not have the right to cancel them under the Cooling-off provisions.
- We may, in our discretion, accept returns for opened Goods in exceptional cases (e.g. defect) but we are not legally obliged to do so.
7.3. Additional exceptions where cancellation rights do not apply include (among others) goods that are clearly personalised, sealed audio/video recordings or software which have been unsealed, and goods liable to spoilage.
7.4. In cases of faulty, damaged or misdescribed Goods, your statutory rights (e.g. under the Consumer Rights Act 2015) still apply, regardless of whether the Goods have been opened.
- Faulty Goods, Damage & Misdescription
8.1. If Goods are faulty, damaged on delivery, or materially not as described, you have the right to:
- Request repair or replacement; or
- Request a refund (full or partial) if repair/replacement is not possible; or
- In some cases, a price reduction.
8.2. You must inform us of any fault or damage within a reasonable time of detection. You may return the Goods (opened or unopened) for inspection.
8.3. We will bear the cost of return only in cases of fault, damage or incorrect supply.
8.4. Subject to proof, we will issue the refund or remedy without undue delay and in any event within 30 days in most cases.
- Returns & Exchanges (Voluntary)
9.1. If you wish to exchange unopened Goods for another product, we may permit it (subject to stock and shipping). You must contact us within 14 days of receipt.
9.2. You will be responsible for returning the Goods at your cost (unless the product was sent in error or defective).
9.3. If the replacement Goods cost more, you will pay the difference; if less, we will refund you the difference, excluding shipping costs.
- Promotional Codes & Discounts
10.1. We may offer discount or promotional codes. Only one discount code may be used per Order unless stated otherwise.
10.2. Codes may have expiry dates, minimum spend, product restrictions or other conditions.
10.3. We reserve the right to not allow a discount if the conditions are not met.
- Intellectual Property & Use of Materials
11.1. All site content, product images, descriptions, branding, and other materials are protected by copyright, trademarks or other IP rights.
11.2. You may use material for personal, non-commercial purposes (e.g. view or download) but please do not reproduce, distribute, adapt, publicly display or create derivatives without seeking and obtaining our written permission first.
- Limitation of Liability & Disclaimers
12.1. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud.
12.2. To the extent permitted by law, our total liability to you under any Contract is limited to the amount paid by you for the Goods in question.
12.3. We are not liable for indirect, consequential or special losses (e.g. loss of profit, loss of business, or reputational harm) arising out of or in connection with the Contract.
12.4. We do not guarantee uninterrupted or error-free operation of the website; we may suspend the site for maintenance or updates.
- Force Majeure
We are not liable for failure or delay in performance due to circumstances beyond our reasonable control (e.g. outbreak of war, courier strikes, extreme weather, earthquakes, supply chain failure, regulatory interventions).
- Governing Law & Dispute Resolution
14.1. These Terms are governed by the laws of England & Wales.
14.2. Any disputes shall be resolved either by mutually agreed mediators administrating a mediation process, or in the courts of England & Wales.
- Variation & Severability
15.1. We may amend these Terms from time to time; changes take effect once published on our website, and apply only to future Orders (not past ones).
15.2. If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force.
